IRCTC scam: Lalu Prasad, wife, son and others summoned as accused by Delhi court

first_imgA Delhi court on Monday summoned RJD supremo Lalu Prasad, his wife Rabri Devi and son Tejashwi Yadav and others as accused in the Indian Railway Catering and Tourism Corporation (IRCTC) scam. Special Judge Arvind Kumar directed them to appear before the court on August 31 in a case related to alleged irregularities in granting operational contract of two IRCTC hotels to a private firm. The CBI, which had on April 16 filed the charge sheet in the case, had said that there were enough evidence against the accused. The CBI had earlier informed the court that sanction has been procured from the authorities concerned to prosecute Additional Member of Railway Board B.K. Agarwal, who was then the group general manager of the IRCTC. Besides Lalu Prasad and his family members, former union minister Prem Chand Gupta and his wife Sarla Gupta, Agarwal, then managing director of IRCTC P.K. Goyal and then IRCTC director Rakesh Saxena were also named in the charge sheet. The other names in the charge sheet include then group general managers of IRCTC V.K. Asthana and R.K. Goyal, and Vijay Kochhar, Vinay Kochhar, both directors of Sujata Hotels and owners of Chanakya Hotel. Delight marketing company, now known as Lara Projects, and Sujata Hotels Private Limited have also been named as accused companies in the charge sheet. The CBI had registered a case in July last year and carried out searches at 12 locations in Patna, Ranchi, Bhubaneswar and Gurugram in connection with the case. The charges in the case include criminal conspiracy (120-B), cheating (420) under IPC and corruption, the central probe agency had said.Charge sheet According to the charge sheet, between 2004 and 2014, a conspiracy was hatched in pursuance of which BNR hotels of Indian Railways, located at Puri and Ranchi, were first transferred to the IRCTC and later, for its operations, maintenance and upkeep, it was given on lease to Sujata Hotel Private Limited, which is based in Patna. It is alleged that the tender process was rigged and manipulated, and the conditions were tweaked to help the private party (Sujata Hotels). It also claimed that Vinay Kochhar, on February 25, 2005, sold commercial property in the form of three acres of land in Patna through 10 sale deeds for ₹1.47 crore to Delight Marketing, in which Sarla Gupta was a director as a front benami holder on behalf of Lalu Prasad. Between 2010 and 2014, this land was further transferred, the CBI alleged. In 2001, it was decided to handover the management of catering services of Indian Railways, including of its hotels, to the IRCTC. Two such hotels — BNR Hotels in Ranchi and Puri — were also identified and an MoU was signed between the Railways and the IRCTC on March 19, 2004. According to an FIR flied by the CBI, Lalu Prasad Yadav, the then railway minister, entered into criminal conspiracy with the owner of Sujata hotels, Sarla Gupta, the wife of his close associate Prem Chand Gupta, an RJD MP in the Rajya Sabha, and IRCTC officials for “undue pecuniary advantage to himself and others”.The probe agency also alleged that BNR hotels were transferred to Sujata Hotels through a rigged and manipulated tender process managed by P.K. Goel, the then-MD of IRCTC. The CBI enquiry shows that the Railways sought bids for developing, operating and maintaining Rail Ratna Hotels on September 16, 2006. The probe agency has alleged that Lalu Prasad Yadav, as the railway minister, was aware about the whole process and was keeping a track of the tender proceedings. It surfaced that while over 15 bid documents were received for both the hotels, IRCTC has no records of bidders other than the Sujata Hotels. It was also alleged that with an intention to render undue pecuniary gains to Sujata Hotels, the bid of another hotel was deliberately and unreasonably given low marks under technical evaluation.“As a result, Sujata Hotels remained the only bidder in financial evaluation and was qualified,” the CBI has alleged, adding after the tender was awarded to Sujata Hotels, the ownership of Delight marketing also changed hands from Sarla Gupta to Rabri Devi and Tejashwi Yadav between 2010 and 2014.By this time Lalu Prasad had demitted the office of railway minister.last_img read more

Observers gobsmacked at new revelation about lost QuadrigaCX currency

first_imgHALIFAX — The revelation that the embattled QuadrigaCX cryptocurrency exchange recently lost track of more than $460,000 in crypto-coins has left some industry observers reeling with disbelief.“I’m totally gobsmacked … that such a thing could happen,” says Manie Eagar, CEO of Vancouver-based DigitalFutures, a business development consultancy that focuses on digital currency and blockchain technologies.“Whoever took over the reins and is acting as the custodian of these funds should have at least done due diligence to avoid whatever happened.”The court-appointed monitor overseeing the search for $260 million in cash and cryptocurrency owed to QuadrigaCX users revealed on Tuesday that the exchange had access to $902,743 in online digital assets, stored in so-called hot wallets as of Feb. 5.However, Ernst and Young said that on Feb. 6 someone working for QuadrigaCX “inadvertently” transferred 103 Bitcoins valued at $468,675 into a so-called cold wallet that remains beyond the reach of the company.Meanwhile, lawyers were expected to gather Thursday in a Halifax courtroom, where a judge will decide who will represent QuadrigaCX’s creditors.Insolvency expert Tim Hill said the case is highly unusual, given that QuadrigaCX has no offices, no employees and no bank accounts.“We certainly haven’t seen anything like this in Nova Scotia — and nothing in Canada that I’m aware of,” he said in an interview.The Vancouver-based exchange was shut down Jan 28 amid a flurry of speculation about the sudden death of its CEO and lone director, 30-year-old Gerald Cotten, who led his five-year-old virtual business from a home north of Halifax.Court records say Cotten, who died suddenly on Dec. 9 while travelling in India, was the only person with access to the digital keys needed to access $190 million worth of Bitcoin and other cryptocurrencies.As well, the insolvent company owes about 115,000 affected users another $70 million in cash.“Transferring funds to wallets they can’t retrieve money from is really mind-blowing,” said Samir Saadi, professor of finance at the University of Ottawa’s Telfer School of Management.“They know they don’t have access to those cold wallets and they still managed to make that terrible mistake …  It tells us a lot about the company’s practices. There’s no backup plans — nothing.”The selection Thursday of representative counsel, which will be overseen by Nova Scotia Supreme Court Justice Michael Wood, is part of a court-ordered insolvency process that was set in motion when the virtual company was granted protection from its creditors on Feb. 5.The purpose of the federal law is to allow insolvent companies owing more than $5 million to continue to operate while drafting a plan to pay off creditors, thereby avoiding bankruptcy.The court order includes a standard 30-day stay of proceedings, which means creditors are prohibited from filing lawsuits against QuadrigaCX until the order expires. An extension is widely expected to be granted by the court on March 5.Hill, a Halifax lawyer who specializes in insolvency and debt restructuring, said the law firms that will be selected as representative counsel will be paid by QuadrigaCX’s parent company, Quadriga Fintech Solutions.“There’s a real danger here that there’s going to be no money to pay these guys,” said Hill, a member of BoyneClarke’s business litigation team and a former registrar in bankruptcy. “Unless they can move quickly to identify some assets, some money, this may not go on too long. People need to be paid.”The representative counsel will speak for the creditors in court, but there’s nothing stopping creditors from hiring their own lawyers.Lawyers from across the country have expressed an interest in the case.Much of the actual money that is owed to creditors is in the form of bank drafts, which the company has failed to deposit in a financial institution because regular banks remain leery of dealing with cryptocurrency businesses.“That’s obviously going to be a challenge, but at some point the court will be asked to assist with that,” Hill said. “The court has very broad authority in these matters.”One user of the platform, Tong Zou of Orillia, Ont., submitted an affidavit to the court, saying he is owed $560,000.The professional software engineer said he had been using QuadrigaCX since 2017.His statement was part of an application to the court to have two law firms — Toronto-based Bennett Jones and Halifax-based McInnes Cooper — appointed a representative counsel.“After speaking with various affected users, I know that the affected users are very worried, confused and in need of assistance,” Zou said in the affidavit.He said he was aware of several other users who are owed more than $100,000 — but he said they have chosen to remain anonymous.Michael MacDonald, The Canadian Presslast_img read more

Jordan Hall From suspended to steward

Two weeks removed from serving a two-game suspension, junior running back Jordan Hall has been named a captain for Saturday’s game against Michigan State. Hall, along junior defensive back and sophomore defensive back Corey Brown, was suspended for the games against Toledo and Akron for receiving impermissible benefits in the form of $200 from a former booster at a Cleveland-area charity event. The NCAA reinstated his eligibility before the Sept. 17 game against the Miami Hurricanes. “He’s a big leader in the locker room; he does a great job,” Fickell said. “He’s handled everything that we’ve asked him to handle with class and dignity.” Hall was all smiles when discussing his captain status with the media. “It’s definitely an honor,” Hall said. “It’ll be one of my greatest memories at Ohio State and it’s definitely exciting.” Hall has improved since his return to the field, rushing for 87 yards in an otherwise-offensive disaster against Miami. He followed up that performance with 84 yards and a touchdown against Colorado. Hall also had a 90-yard kickoff return against the Buffaloes to set up a touchdown. Fickell said Hall’s competitive nature on offense and special teams is what sets him apart from other players. “There’s guys with all types of abilities.
